PMPodium — Ace Your PMP Certification

These Terms of Service and Sale (hereinafter "Terms") govern access to and use of the PMPodium platform (hereinafter "the Service"). By creating an account or subscribing, you acknowledge that you have read, understood, and unconditionally accepted these Terms.

1. Purpose and Acceptance

These Terms govern access to and use of the PMPodium platform, published by PMPodium. By creating an account or subscribing, you acknowledge that you have read, understood, and unconditionally accepted all of these Terms.

2. Contractual Relationship and Payments (Paddle Clause)

PMPodium uses Paddle as an authorized reseller (Merchant of Record). When you make a purchase, the financial transaction is concluded between you and Paddle.com Market Ltd (or its subsidiaries). Paddle is responsible for collecting and remitting applicable taxes (VAT, GST, Sales Tax) based on your tax residence. Any questions regarding a transaction, invoice, or initial refund should be directed to Paddle support, although PMPodium remains your point of contact for technical service access.

3. Intellectual Property (Content Protection)

PMPodium content (questions, explanations, simulators, tracking algorithms) is protected by copyright. We grant you a personal, limited, non-exclusive, and non-transferable license to use the Service solely for personal PMP® exam preparation. The following are strictly prohibited: copying, reproducing, distributing, or reselling any part of the content; using data extraction robots (web scraping) to collect the question bank; capturing screenshots or recording videos of questions and corrections. Any violation will result in immediate account termination without refund, and may be subject to legal proceedings.

4. Refund Policy and Right of Withdrawal

You have 7 calendar days after the purchase date to request a full refund. The service is considered "consumed" once the user has answered more than 10% of the total questions in the PMPodium question bank or has completed more than 2 full exam simulations — in which case no refund will be granted. Refund requests must be sent to support@pmpodium.com.

5. Non-Affiliation and Legal Disclaimer

PMPodium is an independent training service. It is neither affiliated with, endorsed by, nor a partner of the Project Management Institute (PMI®). "PMP®", "CAPM®", "PMBOK®", and "PMI®" are registered trademarks of the Project Management Institute, Inc. PMPodium does not guarantee that users will pass the official exam. Users accept that their preparation and success depend on their own capabilities and efforts.

6. Service Access and Availability

Access is limited to the duration chosen at the time of purchase. Subscriptions automatically renew unless cancelled by the user through their dashboard. We reserve the right to interrupt access for technical maintenance. PMPodium shall not be liable for data loss or access issues due to third-party server failures or your internet connection.

7. Personal Data Protection (GDPR)

PMPodium is committed to protecting your data in accordance with GDPR principles and Moroccan law 09-08. Data collected includes: email, first name, last name, and progress data. Your payment information is never stored on our servers; it is processed exclusively by Paddle. You have the right to access, rectify, and delete your data through your account.

8. Limitation of Liability

To the maximum extent permitted by law, PMPodium and its officers shall not be liable for indirect, special, or consequential damages arising from the use of or inability to use the Service.

9. Governing Law and Jurisdiction

These Terms are governed by Moroccan law. In the event of a dispute, an amicable resolution will be sought first. Failing that, the Commercial Court of Rabat shall have sole jurisdiction.
